Terms & Conditions

1. Definitions

  • "Consentr", "we", "us": Network-IT, operating under the name Consentr, located at Adegemstraat 88, 2800 Mechelen, Belgium (KBO: BE0553.500.113).
  • "Customer", "you": the natural or legal person who creates an account and/or uses the Services.
  • "Services": the Consentr consent management platform, including the consent widget, cookie scanner, policy generator, analytics dashboard and all related functionalities.
  • "Account": personal access to the platform after registration.
  • "Organization": the workspace within the platform to which domains, team members and subscriptions are linked.

2. Applicability

These terms and conditions apply to all use of the Consentr platform and all agreements between Consentr and the Customer. By creating an account or using our Services, you agree to these terms.

Deviating terms of the Customer are expressly rejected, unless otherwise agreed in writing.

3. Account and registration

  1. To use the Services, you must create an account with correct and up-to-date information.
  2. You are responsible for the confidentiality of your login credentials and for all activities that take place under your account.
  3. You must notify us immediately of any unauthorized use of your account.
  4. We reserve the right to refuse, suspend or terminate accounts in case of violation of these terms.

4. Services

  1. Consentr offers a SaaS platform for cookie consent management, privacy compliance and related services.
  2. We aim for 99.9% availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance.
  3. We may modify, expand or limit the Services from time to time. In case of substantial changes affecting your use, we will inform you at least 30 days in advance.
  4. The consent widget is offered as a tool for privacy compliance. Using the widget does not in itself guarantee full GDPR compliance — the Customer remains responsible for correct implementation and configuration.

5. Subscriptions and pricing

  1. The Services are offered in various subscription forms (free, starter, professional, enterprise). Current prices and features are listed on our pricing page.
  2. All prices are exclusive of VAT, unless otherwise stated.
  3. Paid subscriptions are billed monthly or annually via Stripe. By subscribing, you authorize us to automatically collect the amounts due.
  4. We reserve the right to adjust prices. A price change takes effect at the next billing period and is communicated at least 30 days in advance.

6. Cancellation and termination

  1. The free subscription can be terminated at any time by deleting your account.
  2. Paid subscriptions can be cancelled at any time. The subscription remains active until the end of the current billing period. No refunds are provided for the remaining period.
  3. Upon termination, your data will be deleted within 30 days, unless legal retention periods apply.
  4. We reserve the right to terminate your account immediately in case of serious violation of these terms, unlawful use or non-payment.

7. Intellectual property

  1. All intellectual property rights to the platform, software, documentation, design and the Consentr brand name belong to Network-IT.
  2. The Customer receives a non-exclusive, non-transferable right of use for the duration of the subscription.
  3. It is not permitted to copy, decompile, reverse-engineer or distribute the software, unless legally permitted.
  4. Content uploaded by the Customer (logos, policy texts) remains the property of the Customer.

8. Data protection

  1. We process personal data in accordance with our Privacy Policy and applicable privacy legislation (GDPR).
  2. For the processing of personal data on behalf of the Customer (consent records from website visitors), Consentr acts as a processor. The terms for this are set out in our Data Processing Agreement.

9. Liability

  1. Consentr is not liable for indirect damages, consequential damages, lost profits, missed savings or damages due to business interruption.
  2. Our total liability is limited to the amount you have paid us for the Services in the 12 months prior to the damage.
  3. Consentr is not liable for the content or configuration of the consent widget by the Customer, nor for the privacy compliance of the Customer.
  4. These limitations do not apply to damages caused by intent or gross negligence of Consentr.

10. Force majeure

Consentr is not liable for failure to fulfill obligations as a result of force majeure, including but not limited to: internet disruptions, power outages, cyber attacks, pandemics, government measures or problems with suppliers.

11. Acceptable use

It is not permitted to use the Services for:

  • Illegal activities or facilitating thereof
  • Sending spam, malware or conducting cyber attacks
  • Violating the privacy of third parties
  • Overloading our systems (e.g. through automated bulk requests without permission)
  • Reselling or redistributing the Services without written permission

12. Support

Support is offered via email at support@consentr.io. Response times depend on the subscription:

  • Free: best-effort (no SLA)
  • Starter: within 48 hours on business days
  • Professional: within 24 hours on business days
  • Enterprise: within 4 hours, including priority support

13. Changes

We may modify these terms from time to time. Changes will be communicated at least 30 days in advance via email and/or the platform. Continued use after the effective date constitutes acceptance of the modified terms.

14. Applicable law and disputes

  1. These terms and all agreements are governed by Belgian law.
  2. Disputes are preferably resolved by mutual consultation. If this fails, the court of Antwerp, division Mechelen has jurisdiction.
  3. Consumers can also file a complaint via the European ODR platform (ec.europa.eu/consumers/odr).

15. Severability

If a provision of these terms is declared invalid or unenforceable, the remaining provisions remain in full force. The invalid provision will be replaced by a valid provision that approximates the intended purpose as closely as possible.
